Fire NOC in Delhi 2026: Which Buildings Need One, What the Amended Rules Add, and the Building Work Involved

A building in Delhi needs fire clearance from the Delhi Fire Service when its height or use puts it in one of the classes listed in rule 27 of the Delhi Fire Service Rules, 2010: roughly, a residential or office building above 15 metres, a hotel or guest house above 12 metres, a school, nursing home or shop building above 9 metres, every assembly building, and industrial and storage buildings above 250 sqm of covered area. On 28 August 2026 the Delhi government notified the Delhi Fire Service (Amendment) Rules, 2026, which tie the required safety measures to the building bye-laws and set out 18 categories of them, from a six-metre access route for fire engines to fire control rooms with continuous monitoring. Those rules are notified but not yet in force. This guide covers who needs clearance today, what the amendment changes and when, how long a certificate lasts, and why most of what people call the cost of a Fire NOC is building work. The clearance is issued by the fire service, never by a contractor; our part is building what it requires.
Which Buildings in Delhi Need Fire Clearance?
Rule 27 lists the occupancies 'likely to cause a risk of fire', and the DDA reproduces the list as Annexure V of the Unified Building Bye-Laws for Delhi 2016. In that text: residential buildings, other than hotels and guest houses, more than 15 metres high or with ground plus four upper storeys; hotels and guest houses more than 12 metres high or with ground plus three upper storeys; educational buildings and institutional buildings more than 9 metres high or with ground plus two upper storeys; all assembly buildings; business buildings above 15 metres or ground plus four upper storeys; mercantile buildings above 9 metres or ground plus two upper storeys; industrial and storage buildings with more than 250 sqm of covered area on all floors; hazardous buildings above 100 sqm; and pandals seating more than 50 people or covering more than 50 sqm. In each case a mezzanine counts as a storey. The bye-laws' own definitions settle most cases. Coaching centres with more than 20 students are educational buildings. Nursing homes and hospitals are institutional. Banquet halls, restaurants, gymnasiums and places of worship where 50 or more people gather are assembly buildings, and every assembly building is on the list whatever its height. Hostels, dormitories and lodging houses are residential. Have your architect confirm the class before you sign a lease.
A 2025 amendment to the rules, summarised by Lexplosion, restates the thresholds as storey counts that include a mezzanine or stilt floor above ground level, five or more storeys for residential and business buildings, four or more for hotels and guest houses, three or more for educational, institutional and mercantile buildings, and adds underground structures of two or more levels. For an ordinary plotted house the Master Plan for Delhi 2021 says that a building up to 15 metres, or 17.5 metres with stilt parking, 'shall not be considered as high rise building', and adds that 'for purpose of fire and life safety requirements, clearance of Fire Department will be obtained by the individual plot owner'. If you are building stilt plus four, ask your architect at the sanction stage how the current wording applies to your plot.
What Do the Delhi Fire Service (Amendment) Rules, 2026 Change?
According to the PTI report of the notification, the Home Department notified the rules on 28 August 2026. The minimum standards for a building remain linked to its height and class of occupancy, but will now be governed by the building bye-laws; references to the National Building Code in rule 29 are replaced with the bye-laws. The rules list 18 categories of measures to be considered when a fire safety certificate or no-objection is issued, by the fire service or by third-party auditors. They include a minimum six-metre right of way for fire engines up to the premises; protection of exits by fire check doors or pressurisation; fire and smoke barriers, fire stops and smoke management; extinguishers, first-aid hose reels, automatic detection and alarm, public address or voice evacuation, and automatic sprinklers and suppression, as applicable; internal hydrants with wet risers and down-comers, yard hydrants and ring mains; fire pump houses with protected access for firefighters; captive water storage; exit signage, floor numbering and reflective marking in corridors; fire towers and fire lifts; emergency power for pumps, pressurisation, smoke venting, lifts, emergency lighting and alarms; fire check floors and refuge areas; and fire control rooms with automated continuous monitoring. Where the bye-laws do not specify measures for a building, the Director of the fire service may require additional ones. The report says the amendment follows fire tragedies in the city in recent months, including a hotel fire in Malviya Nagar in June.
When Do the New Rules Take Effect?
Not yet. The same report says the rules 'will come into force from the date on which the amended UBBL-2016 are notified by the DDA', and we have not found that notification as of 18 September 2026. Applications pending on the commencement date will continue to be processed under the provisions in force when they were submitted. The government may also relax, modify or remove specific requirements for certain classes of occupancy or for buildings in special areas, which matters in the older parts of the city where a six-metre approach does not exist. The practical reading: a building being designed today should be designed to the amended list, because it is likely to be inspected after commencement; a building applying now is processed under the present rules.
How Does Fire Clearance Work for a New Building?
In two stages, both tied to the municipal process. At the plan stage, clause 9.3 of the bye-laws requires that the building plans of a rule 27 building be 'marked' with the fire and life safety measures, and the fire service examines them as part of the building plan sanction. After construction, clause 2.7.4 says the sanctioning authority shall issue the occupancy-cum-completion certificate only after the no-objection of outside agencies such as the Delhi Fire Service; the agency has 15 days, after which its no-objection is deemed to be issued. The consequence for an owner is simple. Fire measures that were drawn but not built, or built differently, hold up the occupancy certificate, and a building without one cannot lawfully be occupied.
How Long Is a Fire Safety Certificate Valid?
The 2025 amendment changed the certificate from a fixed-term document into one that stays valid unless the fire service suspends or cancels it, and did away with renewal. In its place, the owner, occupier, fire safety officer or fire safety auditor must file an online declaration in Form K before the end of each year from the date of issue; Lexplosion's summary lists a fee of ₹1,000 with the online submission. The same amendment requires the owner or occupier to provide an automated continuous monitoring system for the fire safety measures, and provides for fire safety auditors to be engaged from the list on the fire service's portal. The certificate continues only as long as the measures are maintained, which is a maintenance obligation and not a filing one.
What Does a Fire NOC Cost in Delhi?
The fee is the smaller question: the one figure in the summary of the rules is ₹1,000 with the annual submission. What an owner actually pays for is the building work and the equipment the clearance depends on, and no honest figure can be given without drawings, because a three-storey clinic and a banquet hall need different things. In a new building the measures are designed in from the first drawing and itemised in the quote. In an existing building the work is a retrofit, priced item by item after a survey against the fire consultant's list.
What Building Work Does Fire Clearance Usually Involve?
Much of the list is civil work, and the civil items are the ones that cannot be added cheaply afterwards. Access: a clear approach for a fire engine and setbacks that have not been built over. Exits: the number, width and separation of staircases, enclosed and ventilated or pressurised, with fire check doors, and a fire escape that is continuous from ground to terrace. Compartmentation: fire-rated walls, sealed shafts and fire stops wherever a pipe or cable crosses a floor. Water: an underground or terrace tank reserved for firefighting, a pump room, risers, hydrants and hose reels. Refuge areas and fire lifts in taller buildings. Then the systems: detection and alarm, sprinklers, emergency lighting, signage, and standby power for all of it. What Should You Check Before Leasing or Buying Premises?
Whether the use you intend puts the building in a rule 27 class, and whether the building already holds a fire safety certificate for that use. Whether the approach road will take a fire engine, given that the amended rules name a six-metre right of way. Whether there are two staircases, or room to build a second. Whether there is somewhere to put a fire water tank and a pump. Whether the basement is being used for anything other than what was sanctioned.
